Martin’s Adventures Terms & Conditions
Definiton of terms
Explore s.r.o. (hereinafter referred to as „Martin’s Adventures“ or “MA”) is a tour operator organizing sport activites and travel trips (hereinafter referred to as „Trips“) for its clients (hereinafter referred to as „Guests“). A Trip that is lasting for no more than 24 hours and does not include an overnight stay is referred to as a “Day Trip”. Website www.martinsadventures.cz is MA’s only online booking platform (hereinafter referred to as „MA’s Website“) These General Terms & Conditions (hereinafter referred to as „Terms and Conditions“) are an integral part of a Booking Contract. “Booking Contract” is a legally binding document signed by Martin’s Adventures representative and a Guest.
General Terms and Conditions
These Terms and Conditions govern the rights and obligations between Martin’s Adventures and its Guests with respect to participation at any Trips organized by Martin’s Adventures or any other agreement between Martin’s Adventures and the Guest(s) unless the parties agree differently. In case the parties agree differently concerning a part of the terms and/or conditions governed by these Terms and Conditions, the rest of the Terms and Conditions remains valid. Any such change will be stated in the Booking contract.
These Terms and Conditions may only be amended by written mutual agreement. This contract is governed by the laws of the Czech Republic and the place of dispute shall be the general court of the seat of MA, as determined in accordance with the laws of the Czech Republic.
Conclusion of the Booking Contract
The Booking Contract between Martin’s Adventures and the Guest is concluded based on a fixed offer made by MA in the form of a written Booking Contract. The Guest is obliged to send the completed and signed Booking Contract to MA in an electronic form to either and only of these two email addresses: office@explore.cz and martin@explore.cz. It comes into effect upon MA's receipt of the Booking Contract and the completed deposit payment.
In case that Guest is booking for any Day Trip MA’s Website, there is no need of signing a Booking Contract. By booking a Day Trip and paying for the Day Trip, the Guest agrees to these Terms and Conditions in full
Costs and payment procedure
The costs of all Trips facilitated by Martin’s Adventures are specified in the Booking Contract with an exception for the Day Trips that are booked through MA’s Website. The costs do not cover additional fees and parts of the program that are not described in written form as a part of the Booking Contract or at MA’s Website, namely: individual insurance, flight tickets, compensations for not participating in the whole program of a Trip.
Unless agreed differently, Martin’s Adventures requires a 50% advance payment to make a booking and the balance payment needs to be completed between 60 and 30 days prior to the Trip.
Detailed conditions of advance and balance payments are part of the Booking Contract as well as MA’s banking details.
In case advance and/or balance payments are not received according to the Booking Contract, Martin’s Adventures reserves the right of withdrawing from the Booking Contract.
For all MA’s Day Trips, there is a 100% advance payment needed at time of booking. Prices of tours are in EUROs (€) and include VAT.
Cancellation of the Travel Contract by a Guest
Martin’s Adventures strongly advises the Guests to arrange individual cancellation insurance.
In case Guests want to cancel their participation in any Trip, such information must be sent to MA via email on office@explore.cz. After a cancellation email is received, Martin’s Adventures will charge the respective Guest with cancellation fees according to the date when the cancellation was made.
Cancellation policy is agreed upon and specified individually in a Booking Contract for every trip lasting longer than 24 hours or a trip that involves one or more overnights. As Guests booked on a Day Trip are agreeing to MA’s Terms and Conditions without signing a Booking Contract, unless mutually agreed differently, Group Tour Day Trips cancellation policy stated below applies when signing up for such a Trip
For the best possible transparency, examples of Martin’s Adventures General Cancellations Conditions are as follows:
Group Tour Day Trips
If you cancel at least 24 hours in advance of the scheduled departure, there is no cancellation fee. If you cancel within 24 hours of the scheduled departure, there is a 100 percent cancellation fee.
Private Day Trips
If you cancel at least 7 day(s) in advance of the scheduled departure, there is no cancellation fee. If you cancel between 3 and 6 day(s) in advance of the scheduled departure, there is a 50 percent cancellation fee. If you cancel within 2 day(s) of the scheduled departure, there is a 100 percent cancellation fee.
Large Group Private Day Trips
If you cancel at least 30 day(s) in advance of the scheduled departure, there is no cancellation fee. If you cancel between 29 and 14 day(s) in advance of the scheduled departure, there is a 50 percent cancellation fee. If you cancel within 14 day(s) of the scheduled departure, there is a 100 percent cancellation fee.
Multiday Trips
If you cancel at least 60 day(s) in advance of the scheduled departure, there is no cancellation fee. If you cancel between 59 and 30 day(s) in advance of the scheduled departure, there is a 50 percent cancellation fee. If you cancel within 29 day(s) of the scheduled departure, there is a 100 percent cancellation fee.
Cancellation or alternation of the Travel Contract by Martin’s Adventures
Flexibility is key in all our Trips and enables us to deliver what you expect from us. By their nature, outdoor activities allow for alternatives and a substantial degree of flexibility. Therefore, outline itineraries given for each Trip must be taken as an indication of what each group should achieve, and not as a contractual obligation on the part of Martin’s Adventures.
Martin’s Adventures reserves the right to make changes to the program or schedule of any Trip based on current conditions such as meteorological situation, water level, sudden changes in nature conversation, avalanche risk level, and/or any other objective dangers and unforseen circumstances.
By agreeing to these Terms & Conditions, Guests confirm they understand and accept such changes even if those changes are not invoked or caused by the respective Guest. Guests also agree they accept the risk of changes based on the group nature of any Trip and that they waive any compensations or discounts.
If for any reason the Trip is canceled by MA, a full refund will be made to the Customer.
Safety & Behaviour of Guests
Safety of Guests is always a key focus for Martin’s Adventures staff and its contractors involved in a Trip. To help us keep the highest possible safety level of our Trips, it is essential that Guests abide by the authority of the tour leader, instructors, guides, and all other staff when they take part in any of Martin’s Adventures Trips. Joining any of MA’s Trip signifies the Guest’s agreement to this, and if the Guest commits any illegal act when on the Trip, or if, in the reasonable opinion of the tour leader, the Guest’s behaviour causes or is likely to cause danger, distress or annoyance to him/herself or others, MA may terminate the Guest’s travel arrangements without any liability on MA’s part.
Every Guest participates at any Trip at his/her own risk and responsibility and understands the activities facilitated by Martin’s Adventures might be dangerous regardless of applying all efforts and appropriate care to minimize those risks. The tour leader, instructors, guides, and all other staff that facilitate each Trip act as organizational/operational bodies only. Martin’s Adventures and its contractors accept no liability for death, injuries, or illness incurred during the Trip. Nor does MA accept responsibility for any service provided by any other tour operators.
Every Guest taking part in any MA Trip will be entitled to sign a Risk Declaration document. Failing to do so will result in being denied from the Trip, without a right for a refund.
In case a Guest has any condition, medical or otherwise, that may affect his/her or other Guest's safety or enjoyment of the Trip, it is essential that he or she advises Martin’s Adventures of this at the time of booking.
Before starting the Trip, the Guest must be covered by insurance, which must include adequate coverage for medical expenses and the cost of repatriation, should he or she become too ill or exhausted to continue, including helicopter rescue and air ambulance. This insurance also must cover baggage of the respective Guest. If the Guest joins the Trip without adequate insurance he or she may not be allowed to continue on the Trip, with no right of refund. The Guest is required to carry proof of insurance at all times.
Equipment hire
Should a Guest decide to use any equipment provided by Martin’s Adventures, namely but not limited to mountain or road bike, climbing gear, canoe, paddle, life jacket, helmet, dry bag, snowshoes, etc., such Guest is responsible for the equipment and its loss or damage. The Guests are fully liable for the necessary repairs or replacements of equipment Martin’s Adventures provides them with. In case such a repair or replacement is needed, the Guest agrees to settle up the debt no later than the last day of the Trip to the trip leader, either by cash CZK/EUR or with a credit/debit card.
The Guest must ensure that the equipment provided by MA is adequately secured when not in use. He or she must not use the equipment whilst under the influence of alcohol or drugs, and must endeavour to immediately notify MA in the event of breakdown or loss of the equipment.
Complaints
Even though Martin’s Adventures prepares and executes all Trips with the greatest care, a sudden hiccup may occur, based on the nature of trips involving outdoor and adventure activities. The Guest has the right to raise a complaint in the event of imperfect or incomplete services provided by MA. The Guest must raise such a complaint verbally or in written form to the tour leader and simultaneously in a form of an email to office@explore.cz as soon as the subject event occurs, so that reparation can be made immediately. No complaint claimed after the termination of the subject Trip will be taken into consideration and therefore in such a case, the Guest can not be refunded in any form.
Protection of personal data, photos and videos
Guests understand that Martin’s Adventures is authorized to process their personal data for the purpose of fulfilling obligations and for the purpose of fulfilling legal obligations, in particular: name, surname, date of birth, necessary passport details, bank details, place of residence, or other contact address, e-mail address, telephone connection, data on health status – especially allergies, medications used and other health problems. All personal data will only be stored for the period specified by law, or for the period absolutely necessary.
All Guests agree to the use of photos and videos taken during the Trip for future promotional purposes, thereby granting Martin’s Adventures a non-exclusive, royalty-free, perpetual license to use such photos and videos as well as approve such use by third parties whom MA may engage, without any remuneration to a Guest.
Validity
These Terms and Conditions come into effect as of January 1st, 2025 until the date of its change or its appeal.
